Welcome to huntmall.net. These Terms of use describe the Terms of Use applicable to buyer(s) and seller(s)’ use of the huntmall.net eCommerce platform including but not limited to the web, mobile applications (android & IOS) and mobile optimized versions of the Progressive Web App (PWA) website identified by the uniform resource locator (URL) ‘huntmall.net’. 

This document is an agreement between user(s) (referred to as you, your, User hereinafter) and Huntmall Limited (huntmall.net) (referred to Huntmall, us, we, our, or HuntMall.net hereinafter), and it is therefore legally binding.

Do not use our ecommerce platform if you disagree with these Terms of Use or any part of these Terms of Use.

By using huntmall.net as an individual, for a business or in the name of other organisations, you confirm that you have the authority to agree to these Terms of Use, therefore you bind yourself or yourself and the person(s), the company or other legal entities. 

Huntmall.net may amend any Terms of Use, relevant amended and restated Terms shall be posted on the site. By continuing to use the site and our services, you agree that amended and restated Terms shall apply to you.

User may be required to enter into an additional agreement either online or offline for a particular service or feature(s). In such case where there is a conflict or inconsistency between the Terms and an Additional Agreement, the Additional Agreement shall take precedence over the Terms only in relation to that Service (or feature within the Service).   

Registration

You may not register as a user on huntmall.net if you are under 18 years. Parents and Guardians may, however, create profiles for persons under 18 years. Activities including but not limited to selling, buying and payments under such accounts must be supervised by a responsible adult.

You can own an account only after completing and submitting the registration form on the site.

Account

Your huntmall.net account is not transferrable, authorising a third-party usage is at your own risk. You may be liable to losses arising from failure to keep your account details confidential.

We reserve the right, without prior notice, or explanation to restrict access to or use of your account or certain Services or any features within the Services to paying Users, or subject to other conditions that huntmall.net may impose in our discretion. If you have not breached any Terms applicable on such occasion, you may contact the Refund Office. User Content                                                                                                           

"User content" in these general Terms of Use refers all works and materials (including but not limited to text, graphics, images, audio material, video material, audio-visual material, scripts, and files) submitted by you to us or our website for storage or publication, processing by, or onward transmission.

User content also includes all communications on the website, including product reviews, feedback and comments.

Your content must be accurate, complete, owned/approved by owner and truthful, and must be in accordance with these general Terms of Use.

Your content must be in accordance with the generally accepted standards of etiquette and behaviour on the internet, it must be appropriate, civil, and refined and must not:

o   be offensive, indecent, pornographic, obscene, suggestive or sexually explicit.

o   depict violence in graphic, text, or audio.

o   be religiously or politically intolerant, blasphemous, in breach of racial or religious abhorrence or discrimination legislation.

o   be threatening, rude, or of foul language.

o   be generally intolerable, inconvenient or cause needless irritation or anxiety to any person.

o   be duplicitous or fraudulent.

o   constitute cyber bullying spam, or any such thing regarded as cybercrime.

Your content must not be illegal, infringe any registered or unregistered user’s (including but not limited to persons, companies, and enterprises) legal right. It must be void of all capabilities of provoking legal action against any person (in each case in any jurisdiction and under any applicable law). Your content must not infringe or breach:

o   any right applicable to the usage of our website and all transactions within or related to the platform. Such rights include but not limited to (copyright, moral right, database right, trademark right, design right, right in passing off or other intellectual property right;

any right of confidence, right of privacy or right under data protection legislation)

o   any contractual obligation owed to any person; or

o   any court order.

Any content with history of legal proceedings or similar complaint must not be submitted to our website.

Content in the review function must be genuine, hence you shall not use the review function to provide inaccurate or fake reviews or for any other form communication that does not fall within the use of the review function.

We may periodically review your content and we reserve the right to remove any content in our discretion for any reason whatsoever.

Any unlawful content, material or activity on our platform that breaches these general Terms of Use may be reported by contacting us through the website contact form or report@huntmall.net.

Our Rights to Use Your Content

Unless stated otherwise, you grant HuntMall.net a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display content you post or submit throughout the world in any media.

Other Links

You must not share links of different webpages on our platform. Huntmall reserves the right to restrict or remove users that share links which redirect other users to any website or web page which contains materials that breach the provisions of these general Terms of Use.

If you intentionally or accidentally open a link that redirects you to a different web page, you engage in any activity at your own risk.

Huntmall.net has no rights nor control over such pages and our conditions of use may not be applicable.

You acknowledge that it is a voluntary action which you shall take responsibility for.

Communications & Transactions

You must not interfere with a transaction on huntmall.net by:

·       contacting another user to buy or sell an item listed on the website outside of the platform; or

·       communicating with a user involved in an active or completed transaction to scare them away from a client (buyer or seller) or a product or

·       contacting another user with the intent to collect any payment which does not involve transaction within the platform.

You may post reviews, comments, photos, videos, and other content; send promotions, discounts, updates, and other communications; and submit ideas, concepts, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise detrimental to third parties or objectionable.

Such content must not

·       consist of political campaigning nor trolling,

·       contain software viruses

·       be any form of "spam"

·       be sent with a false e-mail address

·       impersonate any person or entity

·       contain commercial solicitation, chain letters, mass mailings, or unsolicited commercial electronic messages.

Huntmall.net reserves the right (but not the obligation) to remove or edit such content posted by both paid and unpaid users but may not regularly review posted content.

You acknowledge that all users of the website are solely responsible for interactions with other users, and you shall exercise caution and good judgment in your communication with users. You shall not send them personal information including credit card details within the platform, or via emails, SMS, Whatsapp or other social media account provided by any user.

Product Description

Users (sellers) should attempt to describe products as accurate as possible. Huntmall does not warrant that product descriptions of sellers or other content of any of our services and features are accurate, complete, reliable, current, or error-free. If a product offered by a seller is not as described, and you are not satisfied, your sole remedy is to return it unused under the Return Policy of Seller

Pricing

Prices displayed on home page or in ads on huntmall.net is provided by sellers. Different retailers have the rights to price their products. Prices of similar or same products may vary.

 Sales

We only create a safe space for users to transact. Thus, for sellers to sell and buyers to buy.

Sale and purchase contracts or services contracts are entered into directly between the users, and we are not a party to such transactions. Binding sales shall, however, be accepted by us on behalf of sellers.

Sale and purchase contract is effective as soon as buyer confirms purchase of product(s) on the platform. And all commitments shall be fulfilled.

You may personally investigate a user whom you intend to transact with

You hereby release us, our officers, employees, agents and successors from claims, and all liabilities that is either directly or indirectly related to or arises from any interactions or transactions with users.

The seller’s terms of business shall govern the contract for sale and purchase between the buyer and the seller. For transparency and fairness, the following provisions will be expressly and clearly stated, and incorporated into the contract of sale and purchase between the buyer and the seller:

o   the price for the product which includes all taxes and comply with applicable laws in force from time to time.

o   all charges payable by the buyer (including but not limited to delivery charges, packaging charges, handling charges, administrative charges, insurance costs, other ancillary costs and charges);

o   products must be as described in the listing, of satisfactory quality, free from subjects to any third-party rights or restrictions.

Payments

Payment shall be done according to the process/guidelines on the website.

Seller’s registration and buyer’s purchases can be paid through any of the means below;

·       cash/ visa/master cards

·       mobile money transfer

·       bank transfer

·       wallet balance

Other Business

Ad placement on our website may redirect you to a business’ website. We are not responsible for examining or evaluating, and we do not warrant, the services and content of the websites of any of these businesses or individuals. Therefore, we do not assume any responsibility or liability for the actions, product, and content of all these parties. You should carefully review their conditions of use, including but not limited to privacy statements, cookie policy, return policy and general terms of use.

Promotion

The platform allows you to upload your products/items after registration. However, we offer advertising options for boosts and announcements on the Platform. You may contact marketing department.

Payable Services

The Platform is generally free; however, it may contain payable services especially for sellers.

We reserve the right, in our sole discretion, to change the fees and acceptable payment methods from time to time and for any reason.

Unless otherwise explicitly provided by mandatory rules of the applicable law, the fees are non-refundable due to the nature of online services.

Copyright

Huntmall or its content providers own and control all the copyright and all intellectual property rights of all content such as text, graphics, logos, button icons, images, audio clips, digital downloads and data compilations included in or made available on our website or through any services.

Users registered and unregistered trademarks or service marks on our website are their properties and that of their licensors and respective owners. We do not endorse and are not affiliated with the user or any of the holders of any such rights. Thus, permission for usage can only be granted by owners or licensors.

Use of website

You may:

o   view pages from our website in a web browser from your mobile device or a computer;

o   download pages from our website for cache in a web browser;

o   print pages from our website, however, make sure usage of such content is allowed by rights governing it. You may use content for your own personal and non-commercial use under careful caution or consideration.

o   stream audio and video files from our website using the media player on our website; and

o   use our platform services by means of a web browser, subject to the other provisions of these general Terms of Use.

Huntmall.net reserve the right to restrict or suspend access to our website, to features of the website, to pages of our website and/or to functionality upon our website. We may, for instance, suspend or restrict access to the website during server maintenance or updates on the website. You must not evade or bypass or attempt to access any restriction measures on the website. During such activities you may be given notice.

o   use our website for any illegal, unethical, unlawful, fraudulent or offensive activities, or for any purpose that can be described unlawful under all the laws governing the activities of huntmall.net.

1.    If a provision of these general Terms of Use is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.

2.    If any unlawful and/or unenforceable provision of these general Terms of Use would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Assignment

1.    You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these general Terms of Use.

2.    You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these general Terms of Use.

Third party rights

Rights and benefits of these general Terms of Use is for your advantage and ours and it is not intended to benefit or be enforceable by any third party.

Applicable Law

These Terms shall be governed in accordance with the laws of Ghana.

Legal proceedings for disputes, controversy or claims arising out of or in connection to this contract, or breach, termination or invalidity thereof shall be settled by the Ghana Arbitration Centre in accordance with its Rules.

Legal proceedings shall be in English, the official language of the nation.

·       Suggesting promotions and discount sales you may want to participate.

In certain cases, we collect and use your personal information to comply with laws. For instance, we collect from sellers information regarding, business registration, business operating permit, place of establishment and bank account information for identity verification and other purposes

·       Sale of products and services: Personal data like phone number, name and location is needed in order to deliver your products and services purchased on our platform, so we may be required to provide your personal data to such third parties like delivery companies.

·        If you are a seller, you can access your account and other information.

Return and Refund Policy

Returns

Huntmall shall manage returns of products by buyers and acceptance of returned products by sellers shall be managed by us. Acceptance of returns shall be in our discretion in accordance with the description below;

Nonreturnable Products;

Users must know that products under these categories shall not be returned;

·       Underwear

·       Beauty

·       Health

·       Food ...

Eligibility for Return;

·       The product and its package are in good state (not broken or spotted)

·       The product should be deposited to the chosen drop-off station (following your online return request)

·       The product state should match your return reason

·       The preferred refund method and additional details must be provided along with the request

Verification

Returned item(s) shall be verified by our team to approve eligibility of return including reason for return
If your return request is approved, you'll be refunded as per your preferred refund method.
If the team does not approve the request, you shall not be refunded, and the item will be returned to you.

Return Process

After processing the return of an item, you may get refunded or replacement. 

This Return Policy may be amended from time to time and shall be effective in respect of all purchases made from the date of publication of the change on our website.

Seller Notice

Seller must provide a return address within the country of operation.

Refunds

If the buyer’s return request is approved, refunds shall be managed in accordance with the refunds process of the platform, which may be amended from time to time. Process and rules on refunds shall be exercised in our discretion.

Buyer may choose one of these options

o   Vouchers

o   wallet refunds

o   mobile money transfer

o   bank transfers or

o    other method we may determine from time to time.

If voucher is selected, the code shall be sent via email or SMS.

After request approval, buyer shall be refunded with the next 48 hours.

This Refund Policy may be amended from time to time and shall be effective in respect of all purchases made from the date of publication of the change on our website.
